Trade-marks Regulations Amendments.
ARTICLES 1, 2, 3, 4.
Regulation 1.
No alteration.
Article 5. Any applicant for the registration of a trade-mark, or the proprietor of a trade-mark not resident in China, or residing at a distance from a Trade-marks Office, should select an agent to act on his behalf. Such agent on making applications at the office must produce his power of attorney.
Article 6. Applications may either he presented direct to the Trade-marks Bureau, or to any custom-house in the ports for transmission.
Article 7. If application be made by several parties for the registration of the same trade-mark to cover similar classes of goods, and which they do not claim to have used in the past, registration shall be accorded to the first applicant; but if the trade-mark has been used, registration shall be accorded to the earliest bond-fide user of such mark.
If several applications are received at the same time for the registration of the same mark to cover similar classes of goods, and none of the applicants can produce satisfactory proof of use, registration shall be refused to all, unless they agree to withdraw in favour of one of their number.
Article 8. Changes of address of the proprietor of a trade-mark or of his agent must be duly notified to the bureau.
